Legally compliant roll-out

Building projects must comply with a large number of public law regulations - regardless of whether they are classed as procedure-free projects or are still subject to building permission.

Repression versus prevention

With the expansion of projects exempt from procedures, the preventive project review is abandoned in favor of a repressive one. With all the consequences, including complete dismantling.

Complete application

In many procedures in ancillary construction law, there are no uniform requirements for the documents to be submitted, which makes it difficult to submit complete applications for nationwide projects.

Sluggish digitization

Building permit procedures are predominantly analog. Available digital solutions are complicated and inconsistent. A nationwide standardized, digital system does not exist.

Federal structures

Ancillary construction law in particular is further complicated by state-specific implementation laws, ordinances and vague legal terms, leading to discussions and delays.

Lack of personnel resources

Some authorities are understaffed or not sufficiently equipped to examine complex applications efficiently. The result is inactivity, unnecessary additional claims and delays.

Clear guidelines for infrastructure projects

As with advertising installations, a separate regulation for infrastructure projects with an increased public interest would eliminate ambiguities on the part of authorities and applicants.

Identification of regulations to be observed

The regulations affecting a project can be checked for the most parts. In some cases, however, information is not available to building owners, which makes it more difficult to ensure legally compliant construction for projects that do not require a procedure.
